Terms of Service

1. Acceptance of Terms

By accessing and using dronedealer ("the App"), available at dronedealer.net, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our services.

These terms apply to all users of the App, including browsers, buyers, sellers, and contributors of content.

2. Eligibility

You must be at least 18 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement.

Users under 18 years of age are not permitted to use dronedealer as the platform facilitates financial transactions.

3. User Accounts

Account Registration:

• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

Account Security:

• Choose a strong password and keep it confidential
• Do not share your account with others
• We reserve the right to suspend or terminate accounts that violate these terms

4. Marketplace Rules

Listing Requirements:

• All listings must be for drone/FPV-related equipment and parts
• Listings must include accurate descriptions and photos of the actual item
• Prices must be stated clearly in Euros (EUR)
• Items must be legal to sell in your jurisdiction

Prohibited Items:

• Counterfeit or replica products
• Stolen or illegally obtained items
• Items that infringe on intellectual property rights
• Dangerous or illegal items (except lithium batteries as covered in Section 12)
• Items that violate local, national, or international laws

5. User Conduct

You agree NOT to:

• Post false, misleading, or fraudulent listings
• Harass, threaten, or abuse other users
• Use the App for any illegal or unauthorized purpose
• Spam, solicit, or send unsolicited messages
• Manipulate prices or engage in price fixing
• Create multiple accounts to circumvent restrictions
• Scrape, data mine, or extract data from the App
• Interfere with or disrupt the App's functionality
• Impersonate any person or entity
• Submit false, manipulative, or retaliatory feedback for orders you were not part of
• Attempt to access another user's private account data, payment information, or notification tokens
• Violate any applicable laws or regulations

6. Transactions

Buyer-Seller Relationship:

• dronedealer is a platform connecting buyers and sellers
• Transactions are facilitated through our secure payment system
• All sales are final between buyer and seller unless otherwise agreed

Seller Responsibilities:

• Accurately describe items and disclose any defects
• Ship items promptly after receiving payment and shipping label
• Respond to buyer inquiries in a timely manner
• Handle disputes professionally and fairly

Buyer Responsibilities:

• Pay for items promptly through the secure checkout
• Communicate clearly with sellers
• Review item descriptions before purchasing
• Report issues to sellers first before escalating

Feedback:

• After a completed order, both buyer and seller may leave one piece of feedback
• Feedback is verified — it can only be submitted by parties who were part of that specific order
• Feedback must be honest and based on the actual transaction
• Retaliatory, false, or manipulative feedback may result in account suspension

7. Payment and Fees

Payment Processing:

• All payments are processed securely through Stripe
• Sellers must complete Stripe Connect onboarding to receive payments
• Buyers pay the item price plus shipping costs and a platform service fee of 5.5% of the item price and shipping cost combined, plus a \$1.00 fixed fee
• The \$1.00 fixed fee is waived when a valid creator code is applied at checkout
• Sellers receive 100% of the item price — the service fee is paid by the buyer

Creator Codes:

• Creator codes are issued to FPV content creators by dronedealer
• Applying a valid creator code at checkout waives the \$1.00 fixed service fee for the buyer
• The creator earns a small commission (up to \$1.00) on each qualifying transaction
• Creator codes expire 90 days after issue and can only be used by one account
• Self-use of your own creator code is not permitted

Shipping:

• Buyers purchase shipping labels through the platform at checkout
• Shipping is handled through EasyPost with various carrier options
• Sellers receive the prepaid shipping label via email and in their dashboard

Refunds and Disputes:

• Refunds are handled between buyers and sellers
• We may provide dispute resolution assistance but are not obligated to do so
• Payment processor fees are non-refundable

8. Seller Onboarding

To sell on dronedealer, you must:

• Complete Stripe Connect onboarding to verify your identity
• Provide accurate banking information for payouts
• Maintain a valid, verified address for shipping labels
• Comply with Stripe's terms of service

Stripe Connect:

• Your seller account is connected through Stripe Connect Express
• Payouts are transferred directly to your linked bank account
• Payout timing depends on your Stripe account settings and country
• dronedealer does not hold seller funds - payments go directly through Stripe

9. Intellectual Property

App Content:

• The App and its original content, features, and functionality are owned by dronedealer
• Our trademarks, logos, and service marks are protected
• You may not use our intellectual property without prior written consent

User Content:

• You retain ownership of content you post (photos, descriptions, etc.)
• By posting content, you grant us a license to use, display, and distribute it within the App
• You warrant that your content does not infringe on third-party rights
• We may remove content that violates these terms or third-party rights

10. Content Ownership and License

When you post content on dronedealer, you grant us a worldwide, non-exclusive, royalty-free license to:

• Use, reproduce, and display your content within the App
• Modify or adapt your content for technical compatibility
• Distribute your content to other users as part of the service

This license ends when you delete your content or account, except where content has been shared with others or is required for legal purposes.

11. Privacy and Data

Your use of the App is also governed by our Privacy Policy, which is incorporated into these terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

By using the App, you consent to the collection and use of your data as described in the Privacy Policy.

12. Disclaimers and Limitation of Liability

Service "As Is":

• The App is provided on an "as is" and "as available" basis
• We make no warranties, express or implied, regarding the App
• We do not guarantee the App will be uninterrupted, secure, or error-free

Limitation of Liability:

• We are not liable for any indirect, incidental, special, or consequential damages
• We are not responsible for transactions between users
• We are not liable for user content or conduct
• Our total liability shall not exceed the amount you paid us (if any) in the past 12 months

User Transactions:

• We are not responsible for the quality, safety, or legality of items listed
• We do not verify user identities beyond Stripe Connect verification
• You assume all risk when transacting with other users

13. Dangerous Goods and Lithium Batteries

IMPORTANT DISCLAIMER FOR LITHIUM BATTERIES AND DANGEROUS GOODS:

Drone and FPV equipment commonly includes lithium batteries (Li-ion, Li-Po, LiFePO4), which are classified as dangerous goods for shipping purposes. By using this platform to buy or sell items containing lithium batteries, you acknowledge and agree to the following:

Seller Responsibilities:

• You must accurately declare whether your listing contains lithium batteries
• You must provide accurate battery specifications (type, cell count, capacity, watt-hours)
• You are solely responsible for proper packaging of lithium batteries according to shipping regulations
• You must comply with all applicable dangerous goods shipping regulations (IATA, ADR, etc.)
• You are responsible for ensuring the shipping carrier and service selected can legally transport lithium batteries
• Misrepresenting battery information may result in account suspension and legal liability

Buyer Responsibilities:

• You acknowledge that items containing lithium batteries may be subject to shipping restrictions
• You understand that delivery times may be longer due to dangerous goods handling requirements
• You accept responsibility for any customs duties or fees related to battery imports

Platform Disclaimer:

• dronedealer facilitates shipping label purchases but does NOT physically handle shipping
• We are NOT liable for any damage, loss, fire, injury, or death caused by lithium batteries or any other items sold on this platform
• We are NOT responsible for shipping delays, confiscated items, or carrier refusals related to dangerous goods
• We do NOT verify the accuracy of battery information provided by sellers
• We are NOT liable for any fines, penalties, or legal consequences arising from improper shipping of dangerous goods
• All transactions involving lithium batteries are conducted entirely at the risk of the buyer and seller

By listing or purchasing items containing lithium batteries on this platform, you release dronedealer, its owners, operators, employees, and affiliates from any and all liability related to the storage, handling, packaging, shipping, delivery, use, or disposal of such items.

14. Indemnification

You agree to indemnify, defend, and hold harmless dronedealer, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising from:

• Your use of the App
• Your violation of these Terms of Service
• Your violation of any rights of another person or entity
• Your content or listings
• Your transactions with other users

15. Termination

Account Termination:

• You may delete your account at any time through the App settings
• We reserve the right to suspend or terminate your account for violations of these terms
• We may terminate or suspend access to the App immediately, without notice, for any reason

Effect of Termination:

• Upon termination, your right to use the App will immediately cease
• Pending transactions must be completed or refunded
• We may delete your account and content
• Sections of these terms that should survive termination will remain in effect

16. Dispute Resolution

User Disputes:

• Disputes between users should be resolved directly between the parties
• We may provide assistance but are not obligated to intervene
• We reserve the right to remove users who engage in abusive dispute behavior

Disputes with dronedealer:

• Contact us first to attempt informal resolution
• If informal resolution fails, disputes will be resolved through binding arbitration
• You waive your right to participate in class action lawsuits

17. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes through:

• In-app notifications
• Email notifications
• Updating the "Last Updated" date

Continued use of the App after changes constitutes acceptance of the modified terms. If you do not agree to the changes, you must stop using the App and delete your account.

18. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.

You agree to submit to the personal jurisdiction of the courts located within Ireland for the purpose of litigating all such claims or disputes.

19. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

20. Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and dronedealer regarding the use of the App, superseding any prior agreements.
